Following its call for evidence earlier this year, ESMA is consulting on draft guidelines on standard forms, formats and templates to apply for permission to operate a DLT market infrastructure. The proposed draft guidelines are:
- Guideline 1 – outlines the minimum instructions that national competent authorities (NCA) should provide to market participants for submitting their applications to them; and
- Guideline 2 – sets out how applications should provide information and documents requested by the NCAs.
The consultation closes on 9 September 2022 and ESMA will finalise the guidelines by 23 March 2023 (when the DLT Pilot Regime Regulation takes effect in the EU).
