Post-legislative assessment of the Fraud Act 2006

The Ministry of Justice has published a memorandum on the Fraud Act 2006 which provides an updated post-legislative assessment of the Act for submission to the House of Lords Select Committee in light of rising digital fraud.

The memorandum acknowledges that the Fraud Act was intended to give law enforcement the tools they required to tackle fraud effectively and the responses obtained in the review support the view that the Act continues to deliver on these objectives.

The responses also show that the offences are wide enough to cover most fraudulent offending, including those which are digitally enabled, and flexible enough to adapt to developing technology. Practitioners are satisfied that the core offences are fit for purpose and meet their needs and do not require amendment.
