Paypal withdraws from FOS voluntary jurisdiction

PayPal (Europe) S.a.r.l et Cie, SCA is withdrawing from FOS’ voluntary jurisdiction from 1 December 2022. The company became subject to the compulsory jurisdiction after Brexit when it joined the TPR.  But the only complaints at risk are those relating to activities that took place before Brexit but where a complaint has not yet been referred to FOS. This means that:

  • If the activity giving rise to the complaint took place before 1 January 2021 and a complaint has already been made to FOS it will be unaffected;
  • if the activity took place before 1 January 2021 and the complaint has not yet been made to FOS, it must be made to FOS by the earlier of any date specified in the PayPal final response letter when the complaint is made to it, or 1 December 2022;
  • if the activity took place on or after 1 January 2021 then complaints about those activities will be unaffected since they will be covered by the Compulsory Jurisdiction.
