FCA discontinues action against individual for failure to comply with statutory Notice

The FCA has issued a notice of discontinuance in relation to the prosecution of Craig Whyte.

Mr Whyte had previously been charged with an offence of failing to comply with the a statutory Notice issued under Section 49 Regulation of Investigatory Powers Act 2000. FCA decided to terminate the prosecution after receiving new information from Mr Whyte’s previous lawyers relating to the fact that they had not contacted Mr Whyte about the statutory Notice when it was issued, meaning there was no longer a realistic prospect of conviction.
