FCA prosecutes individual for failure to comply with Statutory Notice

In the first prosecution of its kind, the FCA has brought an action against a Mr Craig Whyte for failure to comply with a Statutory Notice issued under section 49 Regulation of Investigatory Powers Act 2000. Mr Whyte was arrested following his failure to disclose passwords (as required by the Statutory Notice) for various laptops and phones which were seized by a warrant issued under section 176 FSMA.

Mr Whyte has indicated a not guilty plea and has elected for trial in the Crown Court.
