Parliament publishes corporate criminal liability briefing

The Commons Library has published a research paper on corporate criminal liabilityr. It looks at the circumstances in which corporates can commit crimes in England and Wales and sets out reform options.

The paper summarises the three current ways in which a corporate can be prosecuted:

  • the identification “directing mind and will” doctrine;
  • vicararious liability, where proof of mental fault is not required; and
  • specific offences, like those in the Bribery Act and Criminal Finances Act
