Emma RadmoreFCA has published the High Court declarations made in the test case, which are the culmination of the test case judgment. The declarations set out how and to what extent the policies in the representative sample used in the case respond to business interruption losses arising from the pandemic.
FCA now asks policyholders to speak to their brokers or advisers if they have questions, but it also plans to publish a policyholder guide to the declarations.
Additionally, it has published the final transcript of the hearing that took place on 2 October and the order of the same date which, among other things, granted certificates for the leapfrog appeal.
