Ex-banker acquitted in FCA document destruction trial

In a case brought by the FCA, Konstantin Vishnyak has been found not guilty of one count of destroying documents in September 2018.

The FCA was investigating Mr Vishnyak for suspected insider dealing when it brought the prosecution for a destruction of documents offence under FSMA, alleging that Mr Vishnyak destroyed documents which he knew or suspected were or would be relevant to the investigation.  The ex-banker was accused of deleting WhatsApp from his phone after being required to provide it.

The FCA has commented that, whilst it is disappointed with the outcome, it respects the verdict.
