ESMA has published draft RTS and ITS for third country investment firms under MiFID 2/MiFIR. It needed to make changes following the IFR and IFD, which requires information to go to ESMA even where the third-country firm has a branch authorised in a Member State, and has now published:
- draft RTS to specify the information that third-country firms need to provide to ESMA to be place on its register of third-country firms, and the information that they must report annually to ESMA; and
- draft ITS on the format for the information.
The Commission will now need to adopt the measures.
