FCA updates BI papers ahead of trial

FCA has updated its list of documents relating to the business interruption insurance test case in preparation for the trial starting on 20 July.

The documents now published are:

  • the agreed list of issues and common ground: this deals with the following, including details of particular issues with particular policy wordings:
    • disease occurrence and vicinity;
    • prevalence;
    • public authority action;
    • exclusions;
    • other matters of construction;
    • causation;
    • qualification and trends clauses; and
    • declarations
  • agreed facts relating to:
    • the chronology of the Government response to Covid-19
    • the Covid-19 disease
    • the prevalence of Covid-19 (still being agreed at the end of 17 June)
    • Notification procedures
    • Sweden
    • earlier pandemics
    • economic impact
    • distribution channels
    • Scilly Isles
  • a new list of Assumed Facts, that have developed from the previous assumed facts, and are based on defined categories of business with assumed facts applying to them.
