FCA publishes defendant BI case skeleton arguments

FCA has published the Defendants’ skeleton arguments in the business interruption insurance test case as well as the Defendants’ joint skeleton arguments on the principles of contractual construction and on causation.

It has also published the trial timetable, sealed court order from the Case Management Conference on 26 June and reminded insurers of the guidance it finalised on 17 June and the list of affected insurers and policies – in relation to which insurers are expected to update FCA as the case develops.

It has also confirmed the trial will be starting on 20 July and will take place from 20-23 and then 27-30 July, and can be viewed live.
