CRR II and CRD V published in OJEU

CRR II and CRD V appeared in the OJEU on 7 June, together with BRRD II and the SRM II Regulation.  The measures, adopted in May, are all part of the banking reform package proposed by the European Commission in late 2016. Among the changes are those that provide for:

  • a leverage ratio for all institutions;
  • a net stable funding requirement;
  • a market risk framework for reporting purposes;
  • new rules no capital requirements for counterparty credit risk and exposures to CCP;
  • a revised Pillar 2 framework;
  • new requirements on financial holding companies and mixed financial holding companies;
  • changes to the credit risk framework in respect of non-performing loans;
  • enhanced prudential rules on AML;
  • enhanced governance requirements;
  • a TLAC requirement for G-SIIs together with enhanced MREL subordination rules; and
  • a new moratorium power for the resolution authority with other targeted improvements to macro-prudential tools.
