FCA makes new rules

FCA’s latest Handbook Update lists rules made in December and January.  The key changes:

  • amend the rules on PCAs and Overdrafts from 18 December 2019: these changes amend BCOBS and CONC to tackle low levels of consumer awareness of and engagement with overdrafts;
  • amend DISP to require lenders and sellers to write to certain Plevin complainants telling them they can make a new complaint in light of RND with effect from 30 January;
  • implement the Consumer Credit (High-Cost Credit) Instrument 2018 from 19 December 2018 in part, and then from 19 March 2019. The changes include additional protections for consumers and guidance in relation to home-collected credit, catalogue credit and store cards;
  • bring relevant parts of the FCA Rules and PERG into line with PSD 2 and include also a requirement to report data on complaints relating to APP fraud – the instrument is already partly in force, with other provisions coming into force in July and September 2019;
  • amend the FOS jurisdiction in respect of small business eligible complainants with effect from 1 April 2019; and
  • apply the Principles and certain communications rules to the provision of payment services and e-money issuance by certain providers, from 1 August 2019.
