Treasury publishes draft Brexit Insurance Distribution and Distance Marketing laws

In readiness for the UK’s departure from the European Union, Treasury has  published further draft statutory instruments including:

  • Financial Services (Distance Marketing) (Amendment) (EU Exit) Regulations 2019: amending the Financial Services (Distance Marketing) Regulations 2004 by removing references to EU/EEA bodies, territories and instruments and replacing the references to the European Consumer Credit Information Form with references to the Pre-Contract Credit Information (Overdrafts) Form
  • Insurance Distribution (Amendment) (EU exit) Regulations 2019: transferring certain functions from EU entities to appropriate UK bodies, e.g. transferring power to the FCA to make technical standards regarding the presentation format of the IPID, replacing references to the EU as well as replacing references to EU legislation with the relevant UK legislation.
